Do I need a will?

If you die without a will in Illinois, the law determines who will receive your property. For example, if you die without a will and you have no surviving spouse and no children, your property is divided among your parents and your brothers and sisters. Your will also provides you with the opportunity to name the person you would want to be guardian of your minor children if something happened to you while they were still young. Wouldn't it be better for you to make that decision than for a court to make it after your death?

If you die without a will and without a spouse, your children will receive all of your property. If they are at least 18 years of age, the property will be distributed to them immediately. Is it a good idea for an 18 year old child to receive a substantial amount of money in the form of an inheritance? Are you absolutely convinced that your child would spend that money wisely?
